NCIAA- Downshift Radio, Exposed!  Possible 2.4 Million Dollar Civil Suit Pending

The National Club Industry Association of America prepares to launch a full scale investigation into the allegations involving Downshift Radio, a New York Based Internet Radio Station and DJ Promotions company accused of multiple allegations for fraud, misrepresentation, gross negligence, bad faith business practices filing false business records, and several possible criminal actions.

Owner/Operator Dan Bino has been the target of a two week investigation conducted by the NCIAA into the allegations that Downshift Radio had falsely represented statistics to more then 1700 professional Dj's who appear to have been swindled by Bino for the past 3 years to the tune of more then $168,000.00 

Bino, passing himself off as self acclaimed Dj Promoter, has admitted to charging more then 1700 Dj's an average fee of $40.00 per month to broadcast mix sets via the internet radio station www.downshiftradio.com claiming that the unlicensed radio station was reaching more then 180,000 concurrent listeners per month, despite his inability to substantiate any of his self professed claims or statistics.

During a 30 minute recorded interview with NCIAA Officials and a top IBM Certified Technical Specialist, Bino, claimed that downshift radio supported a vast data-center employing a network of hosting companies spread across the United States that was so significant they supported more then 11,000 daily concurrent streaming video subscribers through an array of highly sophisticated super-computers networked together to maximize the stations bandwidth usage and sophisticated proprietary programming. Not to mention the extensive division of technical staff utilized to operate such facilities. Sounds like a state of the art facility when compared to the security systems employed by NASA, or the super-computers used by Microsoft’s Software Development Team, Unfortunately for Bino, when confronted with reality, and the actual statistical reports confirmed by Downshift Radio's Primary ISP, Time Warner, their vast array of high tech systems turned out to be nothing more then 2 very basic desktop computers connected to a Standard High Speed Cable Modem that services the two static IP Addresses of the computers connected together thru a generic desktop router. Total Broadcasting Value, $60.00 per month. 

According to top NCIAA Officials, Bino's scam may also be the target of several local criminal charges, currently being coordinated with local and state government officials.  NCIAA spokesman Kenneth Robbins indicated that there have already been several inquires made to the RIAA, which revealed the probability of yet another investigation only this time by the RIAA for various allegations of Piracy and Copyright Infringements by Downshift Records, an independent record label also operated also by Bino.  "Right now we are attempting to identify various individuals affiliated with Downshift in hopes they will take this opportunity to examine the nature of their involvement, and ultimately their potential exposure and liability in the event a Class Action Civil Complaint is filed by the Dj's who have been victimized by Bino, seeking to recover more than $2.4 Million Dollars in damages.”

"I think its a good thing that we not only identify and report these type of suspicious internet companies to the local authorities but expose them and their exploitations to our community of Professional Dj's.  Downshift Radio would appear to not only  have misrepresented themselves to the Dj's they targeted, but may be involved in the unauthorized collection of email addresses from  many unsuspecting users to the Downshift website." Robbins Added.  “At this point we are still collecting information.  This matter is still being investigated, and will undoubtedly require the assistance of other outside agencies, once complete we will forward our findings to our membership, and if warranted to the appropriate enforcement bureaus.  Until then, we have an obligation to not only represent our members but to protect them to the best of our ability, part of that obligation requires we inform them of the current allegations and the status of our investigation.  We are confident this matter will be concluded shortly, right now we are still analyzing records of Downshifts Radio's activities as well as contacting other potential victims."
